Patent opinions from the Eastern District of Texas and the U.S. Court of Appeals for the Federal Circuit

Weekly Digest

Adopted

These are orders adopting a magistrate judge's report and recommendation in full. In the Eastern District of Texas much substantive motion practice is referred to a magistrate judge, who issues a report recommending how the district judge should rule. If a party objects, the district judge reviews the recommended disposition de novo; absent objection, review is for clear error. An order adopting the report makes it the ruling of the court. The reasoning usually lives in the underlying report rather than in the adopting order, which is often short - so the two documents are best read together, and both appear in this collection.
