Patent opinions from the Eastern District of Texas and the U.S. Court of Appeals for the Federal Circuit

Weekly Digest

Affirmed

These are Federal Circuit decisions affirming the judgment below in full. An affirmance leaves the district court's judgment intact, whether it rested on claim construction, a jury verdict, summary judgment, or a post-trial ruling. Some affirmances are reasoned opinions that explain why each challenge failed and become precedent for later cases; others are summary dispositions entered under Federal Circuit Rule 36, which affirm without any written explanation. Both appear in this collection. Where the court wrote, the opinion usually addresses the standard of review that governed each issue, which is frequently what decided the appeal. An affirmance settles the dispute between those parties but does not, by itself, resolve the validity of the patent against the world.
