JMOL / Post-Trial

Judgment as a matter of law asks the court to override a jury verdict on the ground that no reasonable jury could have reached it on the evidence presented. It must ordinarily be raised before the case goes to the jury and renewed afterwards, and it is decided by taking the evidence in the light most favourable to the verdict. Post-trial practice in patent cases also includes motions for a new trial, for remittitur of an excessive damages award, and for enhanced damages on a finding of willfulness. The opinions collected here address these motions and the judgments entered on them, and they often contain the fullest account of the trial evidence.
