Summary Judgment

Summary judgment resolves a claim or defence without trial when there is no genuine dispute of material fact and one side is entitled to judgment as a matter of law. In patent cases it is the usual vehicle for deciding infringement and invalidity once claim construction has fixed the meaning of the claims, and motions are often filed by both sides on overlapping issues. The court takes the evidence in the light most favourable to the party opposing the motion, which is why many rulings turn on whether an expert's testimony creates a factual dispute or merely asserts a conclusion. The opinions here include grants, denials, and the common partial disposition that narrows a case for trial without ending it.
