Terms of Use

Accepting these terms

These terms govern your use of Patent Case Watch. By using the site you accept them. If you do not accept them, please do not use the site. They may be revised from time to time; the version published here is the one that applies, and continuing to use the site after a change means you accept the revised terms.

This is not legal advice

Patent Case Watch publishes public court documents and automatically generated descriptions of them. It does not practise law and it does not give legal advice. Nothing on this site — no holding label, no subject-matter tag, no excerpt, no summary, and no part of the weekly digest — is advice about your situation, and none of it should be treated as a substitute for reading the underlying opinion or for the judgement of a lawyer qualified in the relevant jurisdiction.

Whether a decision applies to your facts, whether it is still good law, whether it has been appealed, reversed, distinguished, or superseded, and what you should do about any of it, are questions this site cannot answer. Only a lawyer who knows your circumstances can. If your situation calls for legal advice, obtain it from one.

Court records are also not the whole picture. A decision may have been amended, vacated, or sealed after publication, and later authority may have changed its effect. Always confirm the current status of a document in a professional citation service before relying on it.

No attorney-client relationship

Patent Case Watch is not a law firm, and no one operating it is acting as your lawyer. Using the site, subscribing to the digest, or writing to the address on the contact page does not create an attorney-client relationship, and nothing you send is protected by the attorney-client privilege or treated as confidential.

Please do not send confidential or sensitive information, and please do not send anything about a live dispute that you would not be content for another party to read. Messages about corrections should contain only what is needed to identify the record and describe the error.

Accuracy, and the limits of it

The classifications on this site are produced automatically and are not reviewed by a lawyer. They can be wrong, incomplete, or misleading. The archive reflects only what the source collection publishes, and it does not contain complete dockets. Coverage, currency, and accuracy are all described on the About page, and you should read it before relying on anything here.

The site, its contents, and its classifications are provided “as is” and “as available”, without warranty of any kind, express or implied, including any warranty of accuracy, completeness, currency, merchantability, or fitness for a particular purpose. The site may be unavailable, incomplete, or out of date at any time and without notice.

The source documents

The underlying opinions and orders are works of the U.S. federal government obtained from the govinfo.gov USCOURTS collection, and are generally not subject to copyright. The selection, classification, arrangement, and presentation of those documents on this site are our own work. You are welcome to read, quote, link to, and cite this site; please do not republish the compilation wholesale as though it were yours.

Acceptable use

Search engines and AI crawlers are welcome, subject to robots.txt. Automated access that degrades the service for other readers may be rate-limited or blocked. Do not use the site to break the law, to interfere with its operation or security, or to attempt to reach parts of it that are not published.

Limitation of liability

To the fullest extent the law allows, neither the operator of Patent Case Watch nor anyone involved in producing it is liable for any loss or damage arising from use of, or reliance on, this site or anything in it — including any decision taken or not taken on the basis of a holding label, a tag, a summary, an excerpt, or the absence of a record. Some jurisdictions do not allow certain limitations, in which case the narrowest limitation permitted there applies instead.

This site links to material held elsewhere, principally govinfo.gov. Those sites are not under our control, and we are not responsible for their content, their availability, or their handling of your information.
