Patent opinions from the Eastern District of Texas and the U.S. Court of Appeals for the Federal Circuit

Weekly Digest

Denied

These are opinions and orders in which the court denied the relief sought. A denial leaves the case where it stood: a denied summary judgment motion sends the issue to trial, a denied motion to dismiss sends the case into discovery, and a denied transfer motion keeps it in the district. Denials are the single largest disposition in this collection, which reflects how patent litigation runs - most motions are contested, many present genuine factual disputes, and a court that finds one need not resolve the merits. The reasoning in a denial is often the fullest account available of why an issue could not be decided short of trial.
